1. Scope of Application

1.1 General scope of application

These General Terms and Conditions (hereinafter referred to as „GTC“) govern the

Use of the facilities of the ATTENTION Badminton Center (hereinafter referred to as „ATTENTION“) at the location Koßgasse 12, 8010 Graz by its visitors.

The hall regulations are an integral part of these GTC. These GTC and the hall regulations are available on the homepage www.attention-graz.at and are clearly visible in ATTENTION. By actually using one of the ATTENTION facilities, the GTC and the hall regulations are deemed to have been accepted by the user.

1.2 Installation of the ATTENTION

The following equipment is considered an ATTENTION system:

• Badminton courts
• Common areas
• Sanitary facilities
• Changing areas
• Catering area/registration
• Outdoor area with parking spaces

Parking spaces:

Until further notice, ATTENTION users are permitted to use the parking spaces and bicycle stands available in front of the ATTENTION facility free of charge for the duration of their stay at ATTENTION, although booking a badminton court does not entitle them to do so.

Any other use of the parking spaces is prohibited; in the event of non-compliance, the vehicle in question may be towed away for a fee.

1.3 Amendment of the GTC

ATTENTION reserves the right to amend the GTC unilaterally. In this case, any changes, as well as the date of entry into force, will be brought to the attention of visitors by means of a notice or on the homepage www.attention-graz.at and accepted with the use of the facility.

2. Opening Hours

The regular opening hours of ATTENTION can be found on the current notice boards, the website and social media.

2.1 Restrictions

At ATTENTION, there may be limited use or closure of the entire facilities due to tournaments, private events (e.g. competitions, summer break, changed summer opening times, Christmas holidays, etc.).

If possible, the restriction of use or complete closure of the facility will be announced in good time in advance by means of a notice in the hall or on the homepage.

An aliquot refund of subscriptions is not possible. Subscription units that have expired will be credited and can be redeemed up to 1 month after the subscription expires.

3. Session Prices

The different prices are communicated both on the homepage and in the entrance area in the form of price lists.

These ID cards must be presented when requested by staff. If a customer is unable to comply with this request, the valid

3.1 Subscriptions

The subscription conditions are part of these GTC and are available in ATTENTION.

4. terms of use

The ATTENTION house rules are available at ATTENTION and form part of the terms of use.

4.1 Use of the badminton courts

Please note that only the booked court may be used. Good cooperation and consideration are important! Disturbing other customers or leaving the courts unclean can lead to expulsion from the hall.

The courts may only be entered and played on with clean, non-marking indoor shoes.

4.1.1 Use at your own risk

Customers hereby declare that they are in good mental and physical condition and accept all risks associated with the sport, of which they are aware, of their own free will and at their own risk.

Playing with socks or barefoot is prohibited without exception for reasons of hygiene and safety.

To minimize the risk of injury, we recommend that you warm up sufficiently before each session.

4.1.2 Smoking ban

Smoking is strictly prohibited in all areas of the hall, especially in the catering area.

4.1.3 Emergency exits

All emergency exits (marked as such) must ALWAYS be kept free of any objects.

4.1.4 Group events

In the case of group events, the leader of the group event is responsible for ensuring that the house rules are fully complied with in all respects by the group participants.

4.1.5 Taking animals with you

It is expressly forbidden to enter the hall with dogs or other animals.

Animals are permitted in the catering area until further notice. Owners must ensure cleanliness and not disturb or restrict other customers. A reprimand can be issued by the staff at any time.

4.1.6 Loan material

Borrowers are obliged to treat the rental equipment with the utmost care. If the rental equipment is lost or damaged, it must be replaced at the list price.

Borrowers are obliged to check the rental equipment for obvious defects (e.g. paint damage / breakages) before use. Defects must be reported immediately.

The rental equipment is only rented for the duration of the reservation and may only be used in ATTENTION.

4.2 Consumption of food and beverages

Eating is prohibited in the hall. Drinks may be consumed in the side area by the tables, but not on the courts themselves.

4.3 Changing rooms

4.3.1 Lockers

ATTENTION provides lockers with keys in the checkrooms.

The lockers are generally only to be used for the duration of your stay at ATTENTION. Locked lockers may be opened and emptied after closing time.

If a key is lost, a fee of € 50 must be paid to replace the locking cylinder.

ATTENTION accepts no liability for items left or locked in the checkroom.

5. liability

Any liability on the part of ATTENTION and its vicarious agents shall be deemed excluded insofar as it is based on slight negligence.

The customer is solely liable for injuries.

The customer is liable for willful destruction of or damage to rental equipment or hall inventory. This will be penalized with a fine.

6 Cancellations

Court/session bookings can be canceled free of charge up to 24 hours in advance. After that, a cancellation fee will be charged. In the event of a no-show for a reservation, the full price of the pitch will be charged.

7. Privacy Policy

The customer agrees that the data provided in the course of using ATTENTION may be used and comprehensively processed for the purposes of contract fulfillment, accounting and internal market research and marketing purposes, including by automated means. The customer also agrees that his/her disclosed electronic mail address may be used for direct marketing by ATTENTION by means of electronic mail, whereby the user may revoke this consent at any time. The revocation can be declared at any time via e-mail to badminton@attention-graz.at

8. Severability Clause

Should individual points of these GTC become invalid, this shall not affect the validity of all other provisions. The contracting parties therefore undertake to replace the invalid provision with a provision that corresponds to the economic sense and purpose of the invalid provision.
